Surely he won't actually be charged unless there's evidence of a REAL threat, though? There's some reasoning possible behind turning this guy into an example, although I definitely think they shouldn't, but actually sending him to jail for 20 years, that's never going to happen, is it? I definitely hope so, because that would be really fucked up.

I was being flippant to be honest. As you say I would imagine he won't actually be convicted. If he is then the American courts aren't what I thought they were.

The trouble is that it is sort of a threat, and not too far removed from the sort of thing you would expect from the nutters who have gone on to do school shootings and the like. One would find it hard to argue against him attracting the attention of the authorities.

Hard to know whether or not the 3 months without bail is appropriate without seeing all the evidence the judge considered before deciding it was the best course of action, but I'm not seeing anything that makes me sure the judge must be wrong.

I can see why it attracted the attention of the authorities and you're right that we have very limited information available compared to the judge who has made the decision. Having recognised that however, I could have sworn there are plenty of (very famous) rappers who mention murders, violence and crime in their lyrics and I don't think they tend to be arrested for saying such things?

Further to that there's the old freedom of speech argument. I should be able to threaten the government in abstract if I want. Hell, I should be able to threaten people in abstract (not in person mind you). I can expect that to draw attention, but that doesn't mean I should be arrested and even if it does, three months without bail? There's either some serious evidence or it's disproportionate.

Might not be appropiate, but a few sentences from Gangsta's Paradise come to mind, not really taken out of concept too much I think:

Sorry, he is the wrong skin color to rap such violence...otherwise the White House would have taken care of this matter long ago. That's the reality - deal with it. If this had been poor Trayvon Martin, Obama would have called this judge out long ago.

Anyway, the government is too busy hiding from the press on their 4 or 5 current scandals of abuse of power and failure to protect American citizens. Little white kid can rot for a while....hell, it'll give him legit' street cred when he's finally free and gets his first record deal.
