Afghanistan is one of the 123 countries. ICC only prosecutes when countries themselves do not/ can not.
Soldiers commiting war crimes in Afghanistan could be prosecuted if their home countries do not.

Looking over the ICC's areas of investigation it seems to almost exclusively investigate African states. The only non-African area I can see is Georgia.

the criminals you mention Telamor were not prosecuted by the ICC, but the tribunal for former Yugoslavia. Different court. There are many different international court in The Hague, the international capitol of justice.

If it's an illegitimate court then those convicted by it must be freed and compensation paid to the families of those that were executed by the court! Free Jeslić, Krstić, and Martić!

The US is a terrorist state that has never adhered to international law. Yesterday for example was the anniversary of the US-organsied military coup in Chile in which a democratic govenrment was ousted and a brutal military regime installed, leading to thousands of civilian deaths, all stage managed by evil war criminal Henry Kissinger.
