1.) This isn't a democracy, this isn't bound by US law. Kestas is the monarch/benign dictator and has delegated authority to the mods/admins to keep cheating at bay.
2.) The clerical error that draug explained is the best analogy I've seen on it.
As Kestas has said "Sorry guys, I unbanned MPM3di4t0R based on a comparison with the wrong account."
The unbanning was a mistake (like the clerical error) and the original punishment reenacted.
There is no double-jeopardy in webdiplomacy, and even if there was, I don't believe this would apply. Double jeopardy is something like being charged with a murder, it being changed to manslaughter, getting 10 years behind bars, the prosecutor is fired for doing a bad job, and a new one comes in and convinces the courts it was a murder in the 1st degree and demanding a life sentence. You can't be retried for the same crime. MPM wasn't charged with the same crime twice. He was charged with one crime and the punishment was a banning. The unbanning and rebanning was a miscommunication in the prison system, not a retrial.
Yes, we have unbanned in the past with users who actively keep in touch, show remorse, and show they can be trust enough to not be banned, but under a heavy watchful eye. It is extremely rare, because a good chunk of our bans are from users that refuse to talk to us or respond to our emails when we are in the process of investigation, so we never hear from them, period. And we give 2, sometimes 3 extra chances.... we see the users log in, but refuse to reply to our emails...
MPM was one of those users, btw. He wrote that he didn't know why, but there are 4 emails written to him explaining the rule, he's violating it, can he let us know his side of the story, etc etc etc... and we were ignored. He didn't take the chance to try to help himself, so (as ALL the emails stated at the end) if there is no response, we have to assume the worst.
