If that were the case, then I wouldn't punish the mafia (by depriving them of their choice of nightkill) for the misbehavior of a townie.
Likewise, I wouldn't deprive the town of their choice of daykill if Yoyoyozo were mafia and modkilled.
Whatever happens will happen independent of the game mechanics.
