Hamish please note next one is 41.
I think you are wrong. The one before me was xxxviii. 38.
There was a mistake in the count--41 is correct.

I think there are only 2 candidates left. Most obvious is Neville Chamberlain, but he died May 10th, 1940. I guess the wording "Alive at any time since 1940" could be interpreted as "Alive at any point after December 31st, 1940", so may still be a valid answer.

I will guess Neville Chamberlain.
That is it.

Congratulations

He died November 9th, resigned on May 10th. Same logic applies though.

NOT Ramsay MacDonald (damo666, free due to tory confusion)
NOT William Gladstone (Jamiet99uk, free due to tory confusion)
NOT H. H. Asquith (cdngooner, free due to tory confusion)
I must say, I had a chuckle writing tory confusion....

Yankees should avoid brit politics. I thought tory was different than conservative.
This person then is
tory
Technically the Tory Party was an earlier party that the Conservative Party then replaced. But we still colloquially refer to Conservatives as "Tories".

In that case I retract my Gladstone guess and I'll go for Stanley Baldwin.
Baldwin didn't die until 1947
Oh damn, for some reason I thought the question had been 1950, not 1940.

It's got to be Balfour due to the declaration and I doubt it's Bonar Law.

So, is it Arthur Balfour?

I'll guess the other Liberal who died before 1940:
Is it Henry Campbell-Bannerman?

Only two fit the criteria. I’ll guess Asquith. Someone else can guess the other.
