Dr Who and Gender recognition
http://www.pinknews.co.uk/2017/07/17/doctor-who-we-regret-to-inform-you-that-you-are-still-legally-a-man/
I know this is mostly meant to be fun (and a serious look at gender recognition laws in the uk) but i make me question one thing.

Is the spousal veto a necessary thing? From a purely contractual perspective. Can't you go 'well if your spouse isn't happy with your new gender, then they will have to apply for divorce.' ??? Thoughts?

Out of curiosity, how many people have been impacted by this?

To be honest I'm not entirely sure what the details of this are, and exactly what it is that people are potentially offended by. It is pretty small beer in the grand scheme of things.

Generally speaking, I feel it should be harder to get married (there should be at least a year of engagement), it should be harder to get divorced, and a partner changing gender should be clear grounds for divorce, with the partner who hasn't changed receiving favourable terms.
orathaic (1009 D(B))
18 Jul 17 UTC
How many? No idea, in ireland until two years ago, it wa nevessary to divorce before you could have you gender identity recognised (because until two years ago same sex marriage wasn't legal.

But then we voted for marriage equality and the govt quietly passed a gender recognition bill allowing anyone over 18 to self declare their own gender identity, basically allowing you sign a document and have your gender officially changed.

I don't know how many this affects. But it is question of human rights, not something which society needs to regulate...

Whose rights did you have in mind? I'm not seeing any rights, either existing or aspired to, being threatened.

Hmmmm...Most people have a good sense of there own sexuality ..apparently this can change around tenn years and late forties ( weird but true )

As to gender identity most people have a fairly solid sense early on in life and it dosn't change ( I am including all Striaght and LGBTIQ) in that .

So if a person is able to be honest about their gender identity and not feel same or stigma due to this then is is much less likely that divorce will be needed for a transgender issue later on in life..

@"Octavious

"

Mostly right to express your self, right to start a family, tight to engage with culture?

Not the concept of rights enshrined in the US constitution, but the more recent concept declared in the Universal Declaration of Human Rights.

You jave the right to employment, so when a country has decent stats showing trans folk tend to have a much higher unemployment rate, a much higher risk of falling into poverty (never mind suicide), you can claim there is a causal link between bein trans-gender and employment - such that discrimination against trans folk is denying them the right to employment (or they are forced to stay closseted for fear of losing their jobs, hence a repression of their right to self-expression).

Ok that's not the issue with marriage, there you have other threats which may work to coerce a trans person, limiting their right to self-expression, or choose to express themselves but lose the family which they had a right to establish (depending on how courts treat custody cases if/when they are forced to divorce...) Especially when being trans is still considered a mental illness - the only mental illness which can be treated by physical surgery?? - but in many places having your gender identity recognised requires that you first be diagnoised with Gender Dysphoria - this is equivalent to claiming that gay men must first prove they are gay - by getting a medical certificate/label of sexual deviance - before being allowed to marry the person they love.

Yes, it is an issue of rights, fundamental human rights. Which we should afford everyone equally.
Octavious (2732 D)
19 Jul 17 UTC
Lots of issues there, some of which I can't say I follow. I don't see any great issue inequality.

Not sure about your objection to the mental illness thing either. A trans person is clearly ill. Whether you define them as mentally sound but with a dysfunctional body, or mentally ill with the right body, seems to be determined by which part medical science finds easier to change as much as anything else. To me, that seems a pragmatic approach.

In terms of a right to a family, I see nothing here that legally prevents a family life. But no-one has the right to force someone else to be their family. A trans person who has lied to their spouse about such a huge part of themselves may well be treated with love and compassion despite this betrayal. However a betrayal it remains, and if the spouse chooses to react differently the law should be firmly on the side of the wounded party.

@"A trans person who has lied to their spouse about such a huge part of themselves may well be treated with love and compassion despite this betrayal."

Betrayal? lies? First, what makes you think they knew this about themselves and weren't in denial and lying to themselves. What is it not the person's responsibility to know their partner before marrying them?

You have immediately jumped to the conclusion that it is always the 'fault' of the trans person - which contributes to the huge numbers of trans folk murdered world wide... they are blamed for being who they are.

However, the right to a family means the state should not be allowed to take your family away from you without just cause - and a fair procedure, like a fair trial. But instead you're jumping to conclusions and allowing a situation where the laws allow for automatic removal of parental rights.

Seriously, you don't see how this infringes on the 'right to a family'?

@"However a betrayal it remains, and if the spouse chooses to react differently the law should be firmly on the side of the wounded party."

BS, the 'wounded party', there you go assuming that one party is harmed by the gender identity of the other. You have every right to get to know someone and to marry them. And if they change, like choosing to go join the army, or quit their high paying job because it turns out they'd prefer more time than all the money they used to earn, you can't go around claiming to be 'the injured party'...

You could file for a no fault divorce. And that would be fine. Claiming that they've changed and thus the reasons you married them - the material circumstances - are no longer the same. So you should entirely be able to file for divorce. But forcing someone to lose access to their family undermines their rights.

As for the medical approach, it has its own issues, but you can see why homophobic twats would support calling all gay people 'sexual deviants' and we as a society are more inclusive by not labeling them as 'sick' just because of some 'medical model'.

The same is true for trans folks. If they have body dysmorphia, that needs to be accurately assessed before (potentially life altering) surgery, but not all trans folk have particularly bad body dysmorphia. Not all want any surgeries, and none of that is anyone else's business (outside of the doctor-patient relationship) - including their government.

I assumed the least we can agree on is that we don't want the government in our bedrooms or looking down our pants.

Orthaic you communist. Why do you care about individual rights? Isn't the state the one who imposes its will on the individual?
orathaic (1009 D(B))
19 Jul 17 UTC
@Capt Brad, are you attempting an ad hominem instead of reading the arguments? Cause i heard you might aswell simply leave the forum if that's all the game you have.

Personal rights to not equate with corporate rights. I may indeed think the state has a role in regulating big businesses while still believing in individual rights. But then i've always taken this position, so perhaps you haven't been paying any attention.

@Ora

"BS, the 'wounded party', there you go assuming that one party is harmed by the gender identity of the other"

Utter bollocks, mate. The harm is not in the gender identity of the other. The harm is in the lies and betrayal of concealing such an important part of yourself from your supposed loved one. In such a case the blame would very much be on the trans person , and that blame should have implications over the outcome of the divorce.

I flat out refuse to believe that a trans person can make it to adulthood, date, and go through an engagement oblivious to the fact that the life they sre portraying is a pile of lies. They are human, not mindless animals. The responsibility is theirs, and keeping this hidden is a betrayal

As a point of interest, if you were planning on joining the army, but kept this hidden from your wife until after the marriage, and then joined up and swanned off on 6 months tours of duty... Yes, that would absolutely be a betrayal. Yes, the wife would absolutely be the wounded party. How on earth could you think otherwise? The wife may choose to accept it, or choose not to, but it should be very much her choice.
orathaic (1009 D(B))
19 Jul 17 UTC
What if you never intended to join the army, despite having a deep desire to. But you decided because of social pressure you would try to be 'normal' and obviously settling down to have a family is the most norm-following thing you can do.

Not realising all this time that the effect of not being in the army with your mates backing you up, supported by a strict hierarchy, and with a clear mission and purpose in life, was having a detrimental effect on your mental health - because the church you were raised in, and the advertising culture which affected your preceptipns, convinced you that if you just settled down and had kids, then you'd be happy?

And probably that nobody is really meant for the army anyway.

Your characterisation ignores the lived experience of any trans person i know.
I highly recommend doing some reading.

Come on chaps, leave the Army out of this. The Army will "make men out of milksops".. It made a man out of the embryonic me, and a man out of The fire breathing MemSahib, Her Indoors.
You sound like the sort of slackers who would rather be at the pictures watching a movie rather than enjoying marching drill on the Parade ground..Well off you go then...Right, Sgt Major marching forth & back, Left right left right.... ( why do people say " back and forth" ?...it's illogical. A chap has to march forth before he can march back. )
